Terms of Use

These terms apply to the Name Day app (iPhone and Android) and the Name Day website (together, "Name Day"), provided by the developer of Name Day, an individual developer based in Israel ("we", "us"). By using Name Day you agree to these terms. Our Privacy Policy explains how we handle your data.

1. What Name Day does

Name Day shows when people celebrate their name days, based on name-day calendars from different countries and traditions. It can match names in your contacts on your phone, remind you on the day, help you send greetings through the messaging apps you already use, and let you invite friends.

2. Who can use it

You must be at least 16 years old, or the minimum age required in your country to agree to these terms without a parent's permission, to use Name Day.

3. Your account

Name Day creates an anonymous account for you automatically; you don't need to register. On Android you can sign in with Google instead, which keeps your invite when you change phones. The people you add stay on the phone either way. If you delete the account, or remove the app without signing in, we can't restore an anonymous account, invite code or perks. You can delete your account at any time in the app's settings.

4. Name-day information

Name-day traditions differ between countries, churches, regions and families, and calendars change. We compile our calendars carefully from the sources listed for each calendar, but we can't guarantee that every date, name, variant or match is complete, correct or the one a person celebrates. Automatic matches of contact names can be wrong; you can correct them in the app. Name Day is for personal, non-commercial use.

5. Greetings and messages you send

Greetings are suggestions. When you send one, you send it yourself through another app (for example iMessage or WhatsApp), and you are responsible for what you send and to whom. Messages you share may include a link to Name Day. Please only send messages that the recipient is happy to receive.

6. Invites and referral codes

You can invite friends with your personal link or code. We record that someone joined through your invite. We do not grant perks for invites. Core features of Name Day never require inviting anyone.

You may not create fake accounts or automate invites.

7. Acceptable use

Don't misuse Name Day. In particular, don't:

• send spam or unwanted messages using Name Day's invite or greeting features;
• access our servers or website by automated means at a volume that affects the service, or try to get around rate limits or security measures;
• try to access other people's accounts or data;
• copy or redistribute our name-day calendars in bulk, except where the source licence of a calendar allows it.

8. Our rights

Name Day, its design, texts and software are protected by copyright and other laws. We grant you a personal, non-transferable, revocable licence to use the app and the website under these terms. Some name-day data is used under third-party licences, which are credited in the app or on the website.

9. Availability and changes

We may update, change or discontinue features of Name Day. We try to keep it available, but we can't promise it will always be available or error-free. Most of the app works offline; features that need our servers (invites, referrals) may occasionally be unavailable.

10. Liability

Name Day is provided free of charge. To the extent permitted by law, we are not liable for missed name days, incorrect dates or matches, or messages you send. Nothing in these terms limits liability that can't be limited by law, such as liability for intent, gross negligence or injury to life, body or health, or your statutory rights as a consumer.

11. App Store

If you downloaded the app from Apple's App Store, Apple's Licensed Application End User License Agreement also applies. Apple is not responsible for the app or its support; we are.

12. Ending use

You can stop using Name Day at any time and delete your account in the app. We may suspend or close accounts that break these terms.

13. Changes to these terms

If we change these terms, we will update the date at the top and, for significant changes, tell you in the app before they apply.

14. Law and disputes

These terms are governed by the laws of Israel. If you are a consumer living in the EU, you also keep the protection of the mandatory laws of your country of residence.
